Inkventive Designs LLC Purchase Terms and Conditions

Thank you for choosing Inkventive Designs LLC for your custom garment printing needs. These Purchase Terms and Conditions ("Terms") govern your purchase of products and services from Inkventive Designs LLC ("we," "our," or "us"). By placing an order, you agree to these Terms.
1. Orders
1.1 Order Confirmation: All orders must be confirmed in writing via email or an approved purchase order. No work will commence until confirmation and payment terms are met.
1.2 Design Approval: Clients must approve all designs, mockups, or proofs in writing before production. Once approved, changes may not be made without incurring additional charges.
1.3 Minimum Order Quantity: Some products may have a minimum order quantity requirement. This will be communicated during the order process.
2. Pricing and Payment
2.1 Pricing: All prices are listed in USD and are subject to change without notice. Quotes are valid for 30 days unless otherwise specified.
2.2 Deposits: A non-refundable deposit of 50% of the total order amount is required to initiate initial design. Final payment is due before production can begin.
2.3 Payment Methods: We accept Credit Cards, Debit Cards, PayPal, Apple Pay, Google Pay or offer various payment plan companies. Payment details will be provided upon invoicing.
2.4 Late Payments: Late payments may incur a fee of 2.5% per day after the due date.
3. Production and Turnaround Time
3.1 Turnaround Time: Standard turnaround time varies depending on the date of design approval and receipt of deposit as well as product type requested. Rush services may be available for an additional fee.
3.2 Delays: Inkventive Designs LLC is not responsible for delays caused by client approval delays, supply chain issues, or events beyond our control.
4. Shipping and Delivery
4.1 Shipping Costs: Shipping costs are the responsibility of the client and will be included in the final invoice unless otherwise specified.
4.2 Delivery Timeline: We will provide an estimated delivery date. However, delivery dates are not guaranteed.
4.3 Risk of Loss: All risk of loss passes to the client upon delivery to the shipping carrier.
5. Refunds, Returns, and Cancellations
5.1 Custom Products: Due to the custom nature of our products, all sales are final. Refunds and returns are not accepted unless the product is defective or an error is made by Inkventive Designs LLC.
5.2 Defects and Errors: Claims for defective products or errors must be submitted in writing within 5 business days of receiving the order. If approved, we will repair, replace, or refund at our discretion.
5.3 Order Cancellations: Orders canceled after design approval are subject to a cancellation fee of 50% of the total order amount or sum of deposit paid, whichever is greater.
6. Client Responsibilities
6.1 Design Files: Clients must provide high-resolution design files in the required format. Additional fees may apply for design adjustments or conversions.
6.2 Intellectual Property: Clients are responsible for ensuring that all designs provided do not infringe on third-party intellectual property rights.
7. Liability and Indemnification
7.1 Limited Liability: Inkventive Designs LLC’s liability is limited to the value of the order. We are not liable for any indirect, incidental, or consequential damages.
7.2 Indemnification: Clients agree to indemnify and hold Inkventive Designs LLC harmless from any claims, damages, or expenses arising from their provided designs or instructions.
8. Dispute Resolution
8.1 Governing Law: These Terms are governed by the laws of the State of Florida.
8.2 Dispute Resolution: Any disputes will be resolved through mediation or arbitration in Miami Florida, as agreed upon by both parties.
9. Amendments and Waivers
We reserve the right to amend these Terms at any time. Changes will be communicated in writing and will apply to future orders.
